Registering to bid means you accept these Terms.

A bid is a binding commitment to purchase. When a lot closes, you have bought it, and payment is due under Section 6.

These Terms govern over anything stated verbally, in a lot description, or in advertising.

Throughout this document, “you” means the registered bidder of record and “we” means Wolf Bay Auctions LLC.

All lots sell as-is, where-is, with all faults. We make no warranty of any kind, express or implied, including no warranty of merchantability and no warranty of fitness for a particular purpose.

All sales are final. Refunds are addressed in Section 9.

Lot descriptions, photographs, model designations, year designations, and specifications are provided as a convenience and are not warranted. You are buying the equipment, not the description.

Hour meters, odometers, and serial or identification numbers are not warranted to be accurate, original, or unaltered.

Equipment is sold without representation as to operability, completeness, or suitability for a particular use. Inspection is available, and it is your best means of determining condition before you bid.

Certain lots are manufactured outside the United States. We make no representation that any lot complies with EPA emissions standards, CARB requirements, ANSI standards, OSHA requirements, DOT requirements, or any other federal, state, or local safety or equipment standard.

Equipment is sold for off-road use only unless a lot is expressly designated otherwise. No lot is represented as street legal or eligible for highway registration.

We make no representation as to the availability of parts, service, warranty coverage, dealer support, or operator documentation.

You are responsible for determining and satisfying the legal requirements that apply to owning, registering, transporting, and operating your purchase in your jurisdiction.

Each lot is designated in the listing as either titled or bill of sale only. Where no designation appears, the lot conveys by bill of sale only.

For titled lots, title documents are delivered within thirty days of payment in full. We do not warrant the timing of documents received from third parties.

For bill of sale lots, we convey the interest we or our consignor holds. We make no representation regarding liens, encumbrances, or prior security interests, and any lien search you consider necessary is yours to conduct before bidding.

Ownership and risk of loss pass to you upon payment in full, or upon the start of load-out, whichever comes first.

No reserve. All lots open at $1.00 and sell to the highest bidder without reserve. No minimum bid, protective bid, or reserve price applies to any lot. Once bidding opens on a lot, that lot is not withdrawn on account of price.

Proxy bidding. You may enter a maximum bid, and the system bids incrementally on your behalf. Where two identical maximum bids are entered, the earlier bid prevails.

Extended bidding. Lots may close on an extended bidding format. Where it applies, a bid placed near a lot’s scheduled close extends that lot by an additional period, repeating until the extension period passes without a bid. The intervals in effect are stated on the auction event page and govern that sale.

Bid retraction. Bids are final. Retraction is granted only at our discretion, and not within twenty-four hours of a lot’s scheduled close.

Consignment. All lots are offered on consignment. Wolf Bay Auctions LLC, its members, and its employees may bid as ordinary buyers, subject to every fee and term that applies to any other bidder.

We may refuse or revoke a registration, or reject any bid, at our discretion.

You owe the hammer price plus an 18% buyer’s premium and applicable sales tax.

Payment is due within five calendar days of auction close.

A processing fee of 2.5% applies to credit card payments and appears as a separate line on your invoice. No processing fee applies to debit card payments. We do not accept personal or business checks. Cashier’s checks are payable to Wolf Bay Auctions LLC.

Goods are released once funds have cleared. Card payments may be subject to a hold period.

Card on file. A valid payment card is required to register and must remain valid while you are bidding. We may run periodic authorizations to confirm validity, and bidding is suspended where the card on file is declined or expired.

Authorization to charge. If payment is not received by the end of Day 5 and no written extension has been granted, you authorize us to charge the card on file for any amount owed, including hammer price, buyer’s premium, tax, processing fees, storage charges, and default fees. You also authorize charges to that card for storage accruing under Section 7.

Chargebacks. You waive the right to initiate a chargeback or payment dispute on any transaction under these Terms. A bidder who initiates one is liable for all costs of response and collection, including attorneys’ fees, and is in default under Section 8.

The removal period is ten calendar days from auction close, by scheduled appointment.

Storage. Lots remaining after Day 10 accrue storage at $25 per lot per day, payable before release.

Extensions. We’re glad to extend a deadline when you need it. Send your request by email before the deadline, and consider it granted once you have our email confirming it. Because these deadlines drive our yard scheduling, we can only act on requests made and confirmed in writing.

Paid lots not removed. A lot you have paid for remains your property while we hold it, and we claim a lien against it for unpaid storage and handling charges.

Where a paid lot remains unclaimed thirty calendar days after auction close, we send written notice to your address of record stating the charges due and the date after which the lot will be sold. If the lot is not removed and the charges satisfied by that date, we may sell the lot to satisfy our lien under applicable Tennessee law. Proceeds are applied to accrued charges and costs of sale, and any surplus is remitted to you.

Unpaid lots. A lot for which payment has not been completed is not your property. Such lots are deemed abandoned thirty calendar days after auction close, are forfeited without refund, and may be resold or disposed of at our discretion. Amounts owed under Section 8 remain due.

Load-out. You are responsible for supplying transport, trailers, rigging, chains, binders, straps, operators, and labor adequate to the lot purchased. Please verify weight and dimensional requirements before you arrive.

We may provide equipment or personnel to assist with load-out as a courtesy, at our discretion. Any such assistance is provided at your risk, and you assume all risk of damage to goods, vehicles, trailers, and property, and all risk of injury arising from load-out, whether or not our personnel or equipment participate.

Safety in the yard matters to us, and we may decline load-out where the transport, rigging, or securement presented is unsafe, inadequate, or unlawful. A declined load-out does not extend the removal period.

Securing and lawfully transporting your load is your responsibility, including weight compliance, permitting, and escort requirements.

Third-party pickup. A third party may remove lots on presentation of the paid invoice and your bidder information. We may ask for additional verification, and release to a third party discharges us in full.

Shipping and hauling. We do not provide shipping or freight services, and all freight cost and risk are yours. We’re glad to point you toward carriers who work this type of freight — see the Shipping tab. We do not endorse any carrier, and any arrangement you make is directly between you and that carrier.

Failure to complete payment, failure to remove within the stated period, or initiation of a chargeback constitutes default.

A defaulting bidder is liable for a default fee of 20% of the hammer price, chargeable to the card on file, in addition to any other remedy.

We may resell any lot in default, and you remain liable for any deficiency between your hammer price and the resale price, plus the costs of resale.

We may suspend or terminate an account and decline future registration.

All sales are final and no refunds are issued.

If we identify a listing error during an auction — goods not in our possession, a duplicate listing, or a materially misidentified lot — we remove that lot before it closes. If an error is identified after close, we cancel the lot and refund the full amount paid. That is the only circumstance in which money is returned, and a refund of the amount paid is the full extent of our obligation.

All invoices are generated with Tennessee sales tax applied.

Exemption requires a valid resale or exemption certificate matching the bidder of record. Email your certificate and your bidder number to [ email address ].

Out-of-state and export purchasers are responsible for the documentation supporting any claimed exemption.

Our total liability arising from any lot or from participation in any auction shall not exceed the amount you paid for the affected lot. We are not liable for incidental, consequential, indirect, punitive, or special damages, including lost profits, downtime, transport costs, or repair costs.

You agree to indemnify, defend, and hold harmless Wolf Bay Auctions LLC, its members, officers, employees, agents, and consignors from any claim, injury, loss, damage, or expense arising from your participation in any auction, from load-out, from transport, or from owning, possessing, using, or operating any lot purchased.

Persons entering the inspection or load-out premises do so at their own risk. We are not liable for injury, death, or property damage occurring on the premises except to the extent caused by our own gross negligence or willful misconduct.

Governing law. These Terms are governed by the laws of the State of Tennessee, without regard to conflict of laws principles.

Arbitration. Any dispute arising from these Terms or any auction shall be resolved by binding arbitration in Wilson County, Tennessee, administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

Severability. If any provision is held unenforceable, the remainder continues in full force.

Entire agreement. These Terms, together with the applicable lot descriptions, constitute the entire agreement and supersede all prior representations.

Amendment. We may amend these Terms prior to the opening of bidding. The version published when bidding opens governs that sale.

Your invoice has to be paid in full before anything leaves, your carrier needs an appointment, and they’ll need a copy of your paid invoice. Book early — the 10-day removal window applies to carriers too, and good haulers get busy.
